In accordance with Procedure Rule 6.03 (d), this report details the work undertaken by the Environment and Leisure Overview and Scrutiny Committee over the year 2004/05 and invites Members to review the topics included in the work programme for future consideration by the Environment and Leisure Overview and Scrutiny Committee.

B. IN-DEPTH ANALYSIS

Fly tipping Review

B.1 At the meeting of the Environment and Leisure Overview and Scrutiny Committee on 15th September 2003 it was agreed that an in-depth review be carried out into the issue of fly tipping in Waverley. The Committee's review of fly tipping was informed by submissions from various organisations including Parish and Town Councils, the Royal Borough of Windsor and Maidenhead, the Police, the National Farmers Union, Hampshire County Council, Surrey County Council, the National Trust, Environment Campaigns (En Cam) and Waverley officers. In addition, several members of the public submitted their comments and views on the issue.

B.2 The Environment and Leisure Overview and Scrutiny Committee considered the outcome of the review of fly tipping and made appropriate recommendations to the Executive on the issue.
Review of Development Control

B.3 In April 2004, the Audit Commission's report on its Comprehensive Performance Assessment (CPA) of the Council found that Development Control performance was poor and not improving. This judgement was based largely on performance as measured by the Best Value Performance Indicators (BVPIs) for planning. The Committee conducted a fundamental review of the Development Control Service as part of its work programme. Evidence was obtained from a member survey, evidence obtained from staff interviews conducted by the Environment and Leisure Overview and Scrutiny Sub-Committee and evidence provided by other local authorities and the Planning Officers' Society at the select committee style meeting held on 18th October 2004. On the basis of the above information and other background material reported, the Environment and Leisure Overview and Scrutiny Committee considered the review of Development Control, drew conclusions and made recommendations and made a final report to the Executive meeting on 7th December on the issue.

C. CALL- IN

C.1 The item, Planning Service: Current Pressures, which was considered by the Executive on 25th May 2004, was called in by four Members who requested that they would like to scrutinise the decision. The part of the decision that was called in was:

‘4. the Executive confirms that single dwellings are small scale developments for the purposes of the delegation scheme and fall within delegated decisions for Officers’

C.2 The Committee decided to endorse the Executive's decision on the understanding that the Executive would put it forward as a recommendation to the next Council meeting so that the Council could, if it wished, review the decision but that it would operate in the interim period.

D. WORK PROGRAMME

D.1 The items to be included on the work programme for 2004/05 for in-depth reviews are to be selected at the March 2005 meeting.

RECOMMENDS that

1. the work carried out by the Environment and Leisure Overview and Scrutiny Committee be noted;

2. suggestions be made, if appropriate, on working methods to be employed by the Environment and Leisure Overview and Scrutiny Committee; and

3. the topics included in the future work programme of the Environment and Leisure Overview and Scrutiny Committee be considered.
