8. ENFORCEMENT ACTION - CURRENT SITUATION

The current situation in respect of enforcement and related action previously authorised is set out below:-


(a) Majorland Rew, Godalming Road, Loxhill, Hascombe (19.06.96 and 20.08.97)

To secure cessation of the use of the land for the stationing of residential caravans and as a contractor’s depot. Further Notices served relating to the barn, mobile home, playhouse and other matters. Appeals dismissed. Notice varied to allow retention of barn. Time for compliance expired 16.07.00 for most things. Offer of Council accommodation refused. Further PCN served. Officers visited the site on 13.05.03. Compliance not achieved. Letter sent to owner’s agent identifying breaches dated 22.05.03. Further offer of Council accommodation refused. Prosecution to follow. Further site visit by Officers on 5.11.04, non-compliance with notice. Further correspondence with agent regarding continuing breach of Enforcement Notice.

Appeal dismissed and notice upheld in respect of additional haulage area. Compliance date 25.09.02. Site inspection has confirmed that compliance has not been achieved. Warning letter sent.

Appeal allowed in respect of change of use of the site to a use by six lorries and two trailers. Discussions with owners’ agents to ascertain timetable for redevelopment proposals (WA04/1583).

(d) Wareham Brickworks, Haslemere Road, Brook (17.01.01)

To secure the cessation of the use of the land for the stationing of any mobile homes or caravans and vehicles or equipment connected with this use and also remove the articulated lorry trailer. Injunction given. Enforcement Notice

served. An application against refusal for temporary mobile home went to High Court on 18.12.01. One mobile home has been removed. Further breach with stationing of two touring caravans. Further Enforcement Notice served on 04.10.04. Compliance date 8.5.05. Appeal lodged.

(e) 45 Birch Road, Farncombe (12.12.01)

To secure the removal of the balcony which has been erected at the first floor of the rear elevation of the chalet bungalow. Legal interests being established. Legal Department considering further response from owner. Enforcement notice served on 06.12.02. Compliance date 17.07.03. Witness statement drafted.

(f) Land at The Star Public House, Milford Road, Elstead (01.05.02)

To secure the removal of a boundary fence erected in place of wall. Condition 3 of application WA01/0693 indicated that, in respect of the southern boundary of the site adjacent to Back Lane, the existing brick wall to be repaired and rebuilt. Retrospective application (WA02/0447) for the retention of the fence refused 01.05.02. New owners of property have been requested to remove fence to comply with terms of original condition. Letter sent requesting removal of boundary fence. New application for modified development is expected. Application not received by 5.11.04. Final warning given to the owners' solicitor. Response from owners is that an application will be submitted. No application received. Enforcement Notice to be drafted.

(g) Land at Beech Cottage, Hookley Lane, Elstead (10.07.03)

Retrospective planning application retention of boundary fence, refused under WA03/0214. Fence required consent following Condition 6 of WA00/0646. Applicant requested to remove fence. No response. PCN served 22.10.03. PCN reply received 11.11.03. Letter sent requesting an application for a more acceptable proposal on 05.01.04. No response received. Meeting with owner on 19.08.04 was constructive. Application expected to show repositioning of fence as at ‘Charters’. Monitoring position. Final warning letter sent.

(h) 49 Minster Road, Godalming (17.09.03)

Detached garage not built according to approved plan (WA99/0162). PCN served 10.07.03. Reply received 14.07.03. Committee resolved to take enforcement action 17.09.03. Enforcement Notice served 10.12.03. Appeal dismissed. Date for compliance 14.01.05. Inspection carried out. Notice not complied with. Draft witness statements have been completed.

(i) Land at Old Portsmouth Road, Thursley (24.10.03)

Two Enforcement Notices served requiring cessation of non-agricultural use and removal of perimeter fence, shed buildings and hardstanding. Appeal lodged. Inquiry held on 16.06.04. Appeal dismissed. One shed allowed to stay. Date for compliance 08.01.05. Notice not complied with.

Retrospective planning permission refused (WA03/2315) and appeal dismissed for retention of a dormer window. Compliance requested 2.2.05.

The objections can be summarised as follows.
1. The applicant previously refused a restriction to a restaurant use.
2. Will the Council be able to enforce the restriction?
3. Will increase the levels of anti-social behaviour and night time disorder and disturbance in the town centre.
4. No side or rear access for waste to the kitchens and other rubbish.
5. Commercial wheeled bins will remain standing on the pavement.
6. Health and Safety hazard.
7. Sufficient food and liquor outlets in and around Godalming.
8. Customers ordering a cheap meal will be able to drink as long as they like.
9. Local Councillors should be polled to see whether they would wish to live next door to the establishment.
10. Businesses do not control the behaviour of people once off their premises.
11. Extended licensing laws will inevitably lead to problems with the town.
12. Why was the application for 4 shops and flats above refused previously.
13. The building is not covered by any preservation orders.
    Letter from Godalming Community Group
1. Concern regarding the way the application is being handled. Consultation letters have been sent to wrong address.
2. Can restricting the A3 use be achieved in perpetuity?
3. Restaurant is proposing to target a younger market. An inexpensive, large scale restaurant of over 7000sq.ft will result in an increase in the number of drinkers in Godalming at night.
4. A high-density restaurant if allowed would result in deterioration in the night time character of Godalming.
5. The size and nature of the proposal would result in material harm.
    Comments by Surrey Police
    1. Godalming is a pleasant place to live and work and visit during the day. During the evenings the town can take on a completely different feel.
      2. There has been a marked change in the town over the last five years, with many restaurants and pubs now present, drawing large numbers into the town centre in the evenings, especially Friday and Saturday nights.
        3. Over recent years the growth of large ‘Theme Pub’ premises which attract a mainly young customer has continued. Cheap beer and drinks promotions have resulted in ‘binge’ drinking. The Police have invested considerable resources in dealing with disorder at the end of permitted hours, with some success which the Police are keen to maintain.
          4. The current application for a Restaurant is unlikely to have a significant impact on the local area. Concern however that over time the premises could change to a ‘public house’. This would add to the cumulative impact of alcohol related premises in the immediate area.
            5. If the Borough Council is minded to grant the application, control measures should be imposed to ensure that alcohol is only served to customers ancillary to a substantial meal.
              6. The plans indicate a bar area with seating is shown. It is noted that the intention is that this is to be used for customers waiting to be seated. The Police expect to see within the Licensing Application Operating Schedule a control measure to ensure that this is strictly adhered to.

              Description of Site/Background

              The site is located on the west side of Queen Street within the Godalming Town Centre and Central shopping Area. Queen Street is not a through road with only pedestrian access to Flambard Way. Queen Street is characterised by a mixture of uses including office, community uses, retailing and residential uses. The site is occupied by a large building of two storey proportions part of a terrace of properties, the building is now vacant although last used as auction rooms for the sale of antique furniture etc. Internally the building has only a ground floor with a large ceiling void. The building internally is in poor condition, with extensive work required to modernise the building.

              Prior to the buildings use as auction rooms the building was used as a garage and coachworks for the repair of vehicles.

              The Proposal

              The proposal is to convert the building internally and change the use from Auction Rooms a use falling outside the use class order (Sui Generis) to a Restaurant use. Internally the proposal is to erect a mezzanine floor with alterations to the buildings front elevation. The existing building has an internal floor area of 360sq.m a mezzanine floor would add a further 78sq.m at first floor level.

              The mezzanine floor would measure 12m in width and 6.5m in depth and would include additional dinning area, and office and store space.

              Alterations to the front elevation in the form of two new entrances are proposed, replacing the existing garage like timber doors.

              Submissions in Support

              The applicants state in their supporting evidence that they wish to start a chain of restaurants in the form of an up-market version of the Nando’s chicken concept, serving wood-flame rotisserie chicken in stylish and contemporary surroundings at reasonable prices.

              A small area of the restaurant will be set aside for soft seating, which will be used, as a waiting area for guests who are going to be dinning in the restaurant. There are no plans to operate this area as a public bar, and will only serve alcoholic drinks to guests who are booked to dine in the restaurant.

              The restaurant is to be the first of a number planned across the South-East, the design of the restaurant will be based upon a cross between Zizzi and Nando’s food. The key design elements will be prominent placing of the rotisserie and the feature of wine barrels on display behind the bar. The site in Godalming is the key to the success or failure of this business. The applicant considers that this restaurant will be an asset to Godalming in a similar way in which The Bel and the Dragon is.

              The applicant for the application is the same as for the previously refused application as they are the freeholder of the premises.

              The application premises measure 3,200sq.ft and not 7,000sq.ft as stated by objectors.

              The reference to the restaurant offering inexpensive high volume food is not accurate and purely speculative by the objectors.

              There is provision for an internal rubbish storeroom on the plans.

              The application is solely for a licensed restaurant operation and not for unrestricted A3 use.
              The potential proprietor has stated that the last thing he would want to do would be to attract an unruly crowd of youths to the premises. The type of food to be served would not compete with bar food prices.

              No objection to the restrictions as suggested by Surrey Police.

              If there is currently anti-social behaviour in Queen Street it is attracted by the fact that the businesses in the road have all closed in the evenings, this behaviour would be put off by restaurant full of customers.

              The applicant states that they have held a Justice’s On-Licences for over 8 years and is fully aware of the responsibility which comes with the position of licensee and would not jeopardise his licence or business by encouraging excessive drinking in the establishment.

              Relevant Policies

              Main Planning Issues

              The main issues to be considered is whether the proposal conflicts with Council Policies TC1 and TC3 which seeks to maintain and enhance the role of town centres as the focus of shopping and commercial life in the town centre. The objective of Policy TC1 is to maintain and promote a mix of uses within the town centres ensuring the town centres are a focus on shopping, commercial and social life in the Borough. TC1 paragraph (b) states that the Council will encourage and retain retail uses and other commercial and community uses which attract customers and visitors during and beyond normal shopping hours and add visual interest within the centre. Under the Town & Country Planning Use Class Order Auction Rooms are not classified as retailing uses but as a use falling outside the Use Class Order as such the introduction of an A3 use and in this case an A3 use restricted to solely a restaurant use is considered to comply with both Policies TC1 and TC3. Town Centre Policy TC3 seeks to ensure a mixture of uses, which generate activity during and beyond normal shopping hours. The issue of anti social behaviour surrounding A3 uses has been considered in some depth, indeed the previous planning application WA03/1833 was refused for this reason and the subsequent appeal dismissed for this very reason. Surrey Police have commented on the application and are of the opinion that a restaurant establishment such as that proposed is unlikely to have a significant impact on the local area. The concerns raised by the police relate to possible that the restaurant will change to a pub use over time. With regards to the possible change to a pub use at a later stage, this would be prevented by the fact that the permission if granted would only be for a Restaurant use and conditioned to this effect. Members may also like to note that the Town and Country Planning Use Classes order is in the process of being changed and as of the 21st April 2005 an A3 use will include restaurants, snack bars and cafes. A new use class A4 will incorporate Pubs and bars a further use class A5 will incorporate Take-Away outlets. Once the new Use Class Order comes into force express planning permission will be required for an A3 restaurant to change to an A4 Pub or Bar. Importantly to note are the Planning Inspectors comments when the planning application for an open A3 use on this site was refused planning permission WA03/1833.

              The Inspector stated that Queen Street was an important pedestrian route between the town centre and the residential areas to the south. He accepted that the street was a relatively quite street in the evenings containing a small number of residential properties, a large public house into this street would be likely to result in noise and disturbances which in the Inspectors opinion would seriously harm the living conditions of the occupiers due to noise and disturbance. The sale of hot food for the consumption off the premises and would have a similar effect. The Inspector however felt that a condition restricting the proposed use of the premises to exclude a use primarily for the consumption of alcohol or the sale of hot take away food would be likely to reduce such noise and disturbance to an acceptable level. The Inspector stated “In my view use as a restaurant would be likely to reduce the number of people at the premises result in a more gradual dispersal of patrons and avoid the problems of binge drinking and rowdiness often associated with large, town centre bars”. The Inspector nevertheless dismissed the appeal on the grounds that the applicant at the time expressly stated that they required an unrestricted A3 use. The current proposal for a restricted A3 use solely for a Restaurant use is considered to be in keeping with the comments as set out by the Planning Inspector and supported by Surrey Police. Officers are of the opinion that a condition restricting the use of the premises to a Restaurant use within the current A3 use class classification is reasonable and enforceable particularly as such a condition was supported by the Planning Inspector. The building although not of listable quality remains an interesting building retaining a number of features associated with the buildings previous use as a garage/coachworks. The proposed new use is considered to be a type of viable use that would ensure that the building is retained as the applicants obtained planning permission following an appeal to demolish the building and redevelop the site with three retail shops and five flats above in 1996 and subsequently amended in 2002 under permission WA02/1496. The proposal would involve alterations to the front elevation replacing the two sets of garage doors with glazed new doors and windows. The proposed external alterations are considered acceptable and in keeping with the design of the building and would not have a negative appearance on the character and appearance of the street scene.

              Conclusions

              The development hereby recommended for approval has been assessed against Policies TC1, TC3, D1 and D2 of the Waverley Borough Local Plan 2002 and material considerations, including third party representations. It has been concluded that the development would not result in material harm that would justify refusal in the public interest.

              SUMMARY OF REASONS FOR GRANTING PERMISSION

              The development hereby granted has been assessed against the following Development Plan policies: Policy SE4 of the Surrey Structure Plan 2004, Policies TC1, TC3 D1, D2 and D4 of the Waverley Borough Local Plan 2002 and material considerations, including third party representations. It has been concluded that the development would not result in any harm that would justify refusal in the public interest.

              Description of Site/Background

              The application site is located within the campus occupied by the college and is to be found between the original school building and the modern arts building. It is located on the eastern edge of the campus and backs on to dwellings in Tuesley Lane. Currently on site are a 1960’s 2-storey flat roofed building, housing the existing independent learning centre (ILC), and 2 temporary classrooms that have a total floor area of 985 sq.m.

              It should be noted that planning permission was granted in outline for a number of buildings on the site originally in 1995. It has since been renewed. This included a new library building that was to be situated to the south east of the Art building

              The Proposal

              It is proposed to demolish the existing independent learning centre and classrooms and to replace them with a purpose built ILC on the site of the existing, with a new classroom block to the rear.

              The proposed ILC would be of two storeys on the east side, rising to three storeys on the college courtyard side, with a large single plane roof. The ground floor would comprise 8 class rooms and 2 workrooms with the new ILC on the upper floors. Access would be via a “pod” that would be placed within the courtyard and would contain a lift, stairs, toilets and kitchen facilities. The front and rear elevations would be fully glazed, with louvres shielding the windows from glare.

              This building would be linked to the original college building by a “lightly covered circulation route”.

              The replacement building for the temporary classrooms is located to the rear of the new ILC as a “tail” to the main building, linked by a glazed street along the western side. It is proposed to be a single storey building with a curved roof form.

              Submissions in Support

              A lengthy design statement has been submitted in support of the application. In summary, it raises the following points:-

              The existing buildings were built in the 1096s and are outdated and outworn
              The college is large and successful and has grown by 13% since 2001
              To increase the amount of space per student to the median benchmark set by the Learning Skills Council and to maintain student numbers at around 1452 full-time equivalents, the college will need to provide around 3,500 sq.m. additional floor space
              The college aims to provide high quality facilities to support the excellent standards of education
              Teaching rooms are presently overcrowded and social space for students is limited
              The proposed ILC building will provide specialist space for independent learning, library and careers
              The scale of the building on the eastern boundary is similar to the existing
              The fully glazed walls are shaded by external louvres
              The classroom block is designed as a ‘tail’ to the ILC building and enhances the space that is currently more of a back area to the campus
              The college already has outline permission for a new ILC building located to the south east of the arts block. This location is considered too remote from the centre of the campus and too close to houses in Tuesley Lane.

              Main Planning Issues

              The main issues for consideration are set out in Policy CF3 of the local plan. The relevant items for consideration relate to the impact of the proposals on the locality and the relationship of the new building with others on the campus.

              The site for the proposed buildings is relatively discrete and cannot be easily seen from outside the campus. Glimpses of the proposed two storey building may be had from Tuesley Lane, but it is not considered that it would intrude upon the street scene. Dwellings in Tuesley Lane are set some 50m from the boundary with the college, which is reasonably well screened by planting within the gardens of the dwellings. Views of the roof expanse will be had from the gardens, but it is considered that the building would not appear as over-dominant or intrusive to the occupants of these dwellings. The elevation facing towards them is fully glazed, but the glazing is to be screened by louvres, thus preventing any overlooking from the upper floor.

              In comparison the impact of the single storey classroom building would be relatively benign. This building would not be seen from outside the site.

              Policy CF3 also requires development not to detract from the character and appearance of the establishment itself. The proposed ILC building is to be located on the eastern side of the central courtyard that is enclosed by a variety of buildings of various styles and ages. Within the courtyard are covered walkways that clutter this important open area. It is proposed to provide a new covered link to the main building and to remove the existing walkways.

              With regard to the appearance of the building itself, a design brief has been submitted with the application, but it does little to assist officers with their understanding of the principles of the design which appears to have been very much driven by the accommodation required within it. However, in a further letter, the college has emphasised that this is a building of a radical, modern and exciting design that sits well with the ethos of the college. They go on to say that it is designed to provide a landmark structure, contrasting but also unifying the very disparate architecture that currently exists on the site, including a number of rather bland 1980’s and 1990’s buildings.

              Officers have some concerns that the proposed building seems to dominate its neighbours, particularly the original building. At its southern end, the ILC building would be attached to the existing arts building and would have a height approx 2.4m over the ridge height of the arts building and 7.2m over the eaves. At its northern end, there would be a gap of some 2.3m between it and the main building. It would have approximately the same height to the ridge of the main building, although it would be 5m above the eaves.

              Although the proposed ILC would be higher than its neighbours, it replaces an existing outworn building and provides a modern building to complete the eastern side of the central courtyard. This is an important space within the college and, on balance, it is considered that the proposed building will complement the existing buildings.

              The single storey classroom block to the rear of the existing arts block is linked to the ILC by a glazed walkway. It is tucked away behind the arts building and officers have some concerns that it appears excluded from the general circulation area of the college. However, the existing classrooms have a similar relationship with the arts block and officers are of the opinion that there would be no material change from the existing correlation of buildings on this part of the site.

              Conclusions

              The proposed developments are in replacement of existing outworn buildings and whilst they represent a material change in design and appearance, they provide the college with much needed up to date accommodation. The proposed buildings will not be readily visible from public view from outside the site and it is considered that that the proposals are acceptable.

              Summary Of Reasons For Granting Permission The development hereby granted has been assessed against the following Development Plan policies: Policies DN15 and SE4 of the Surrey Structure Plan 2004, Policies CF3, D1 and D4 of the Waverley Borough Local Plan 2002 and material considerations, including third party representations. It has been concluded that the development would not result in any harm that would justify refusal in the public interest.

              Description of Site/Background

              The proposal falls within the Charterhouse School site outside the built up area of Godalming located on the South side of Hurtmore Road, the entire site falls within the Green Belt. The school site incorporates a number of listed buildings the proposal the subject of this planning application relates to a single storey out building of limited architectural merit. The building is sited opposite a Grade II Listed building and as such a Listed Building application for the demolition works is also being considered.

              The Proposal

              The proposal is to replace an existing single storey building with corrugated metal roofing with a two-storey building of 1150sq.m providing 6 classrooms on the ground floor and six on the first floor. Although of two-storey proportions the building would have a height of 12m to the ridge of the pitched roof. The proposed building would have a length of 33m. The proposed building would incorporate design features from neighbouring school buildings. The proposal building would be constructed using Portland stone cladding panels with Bargate stone plinth. The pitched roof would be covered with plain clay tiles.

              Submissions in Support

              The existing single storey building to be demolished is also known as The Old Workshop Block, is situated on the eastern side of the main complex of buildings, opposite the Lecture Theatre.

              The application seeks planning permission for the demolition of the existing building, with a floor area of some 383 square metres plus plant basement area, and its replacement with a new two-storey Classroom Block on a similar footprint.

              The present building comprises 4 Classrooms, together with Administrative Offices, Post Room and Admissions Office. It has an overall length of 26.5m, width of 14.45m and a height to its ridge of 5.5m. The existing building is an old pre-fabricated building with pebble-dash render finish, and has outlived its useful life and essentially needs to be replaced.

              The proposed replacement Teaching Block is of two-storey construction with a floor area of 1150sq.m. The new building provides 6 classrooms on the ground floor, with 6 on the first floor, together with a plant room in the basement. This new Teaching Block is fully accessible to the disabled with provision of a lift to the northern end of the building. The proposed new building is to be connected to the adjacent building to the north by way of a small glass link at ground floor level.

              The buildings design takes elements of design from varying features found elsewhere in the main School complex. Portland stone cladding panels with horizontal featured joints on a Bargate Stone Plinth are proposed for the buildings materials. Two large two-storey height feature windows have been incorporated on the front west, elevation with glazing to all windows set in Grey powder coated aluminium box sections with Portland Stone surrounds.

              The building would be used for Careers Offices and Stores on the ground floor with two classrooms above, on the first floor.

              Main Planning Issues

              The proposal needs to be considered in the light of local plan policies RD5 Institutional buildings in the Green Belt.

              “Outside settlements in the Green Belt proposals for the redevelopment extension and infilling of institutional buildings will be considered in accordance with Policy C1..”

              Policy C1 – ‘Development in the Green Belt Outside Settlements’ states;

              Within the areas defined as Green Belt on the Proposals Map and outside rural settlements identified in Policy RD1, there is a general presumption against inappropriate development. This will not be permitted unless very special circumstances exist. In all circumstances, any development which would materially detract from the openness of the Green Belt will not be permitted.”

              The proposal involving the construction of a large new building in the Green Belt represents inappropriate development. It is necessary, however, to consider whether there are any very special circumstances to overcome this inappropriateness.

              It is considered that the proposal on the site of an existing building in the main grouping of school buildings and constructed on the footprint of the existing building it is considered that the proposal would not have any detrimental impact on the openness of the Green Belt and would not materially detract from the character and appearance of the establishment itself..

              The proposal results in an increase in floorspace over and above the existing buildings size. It is nevertheless accepted that the existing prefabricated building is not suitable for modern day teaching facilities, the replacement building although larger is in a style and design more in keeping with its surroundings.

              The Historic Buildings Officer raises no objections to the proposed new development and the demolition of the existing single storey teaching block.

              It is considered there circumstances represent “very special circumstances” to overcome the inappropriateness of the development in the Green Belt.

              As the development represents inappropriate development the application should be referred to the Development Control Committee and GOSE if members are minded to grant permission.

              Conclusions

              The development hereby recommended for approval has been assessed against the Waverley Borough Local Plan 2002 Policies C1, D1, D2 and material considerations, including third party representations. It has been concluded that the development would not result in material harm that would justify raising an objection in the public interest.

              Description of Site/Background

              The planning application is being brought to Committee for consideration due to the Chairman of Go Godalming being a member of the Committee.

              The site is located North of Great George Street on the Burys. The site is within an Area of Strategic visual importance where Policy C5 applies. The site is within a flood plain and within the Godalming Conservation Area. The bandstand sits between the Bowling Green and St Peter and St Paul’s church. The site already has a slightly raised bandstand area, which is hexagonal in shape and measures 5.7m x 5.7m.

              The Proposal

              The proposal is to enlarge the bandstand to a width of 8m x 8m and erect 0.75m high ornate railings.

              Submissions in Support

              The applicants are seeking to enhance the existing bandstand as part of a community project supported by two Rotary Clubs as their community project to celebrate the Centenary Year of Rotary. The Council Executive have given landlord consent for the project to proceed.

              Rotary International has encouraged clubs throughout the world to engage in a community project to celebrate the centenary of Rotary International. The Rotary Club of Godalming and the Rotary Club of Godalming Woolsack have combined with the Go Godalming Association and Godalming Band in order to improve and refurbish the current bandstand.

              The improved bandstand will be beneficial in attracting a greater number of users to the town and particularly to The Burys. It will be a visual improvement on the current concrete platform and will help the local economy by bringing more people to central Godalming during the concert period. The bandstand will be open to use by all members of the community and will improve safety for users of the current facility.

              The bandstand will be available for use by a variety of organisations for band music, other concerts, operatic and drama societies, and may provide the centrepiece for major events held in and around the town.

              The background to the bandstand is that it was built in or around 1920 and regularly hosted concerts up until the early 1960’s. Last year Go Godalming Association organised five summer concerts, which proved very successful and attracted over 1,200 people.

              The bandstand is a concrete platform approximately 22ft in diameter and standing 2ft out of the ground. Whilst the concrete is generally in sound condition, there is no edge protection thus making it difficult to use. With its limited diameter it is also unsuitable for functions other than traditional brass bands and some of them even find that they are restricted in numbers on the bandstand with some of their players having to sit on the grass.

              It is proposed to extend the surface by approximately 2ft providing suitable access on to the platform.

              The current bandstand is visually unattractive and is not ideal given its diameter and lack of railings. The concerts promoted by the Go Godalming Association have proved to be very successful. The popularity of the band concerts and the continuing success of Godalming Music Festival would improve the vitality of the town and bring visitors into the town. The Council does not have the resources to undertake the project and it would be unable to access the level of external funds required. Therefore, in supporting the Go Godalming Association and the Rotary Clubs, the Council realises that this would be a significant environmental improvement at The Burys for a relatively small amount of partnership investment.

              Main Planning Issues

              The proposal needs to be considered in the light of a number of relevant local plan policies.

              Policy C5 Areas of Strategic Visual Importance seeks to ensure that these areas are maintained and enhanced, development inconsistent with this objective will not be permitted.

              The proposed development is relatively modest increasing the size of the bandstand area by 1.3m and erecting a small ornate metal railing. The proposed materials of barstone walling around the wall of the bandstand and brick pavers will enhance the appearance of the bandstand from its current non-descript concrete raised hexagon. The proposal would not have any significant impact on the area of strategic visual importance.

              The proposal falls within the Godalming Conservation area where Policy HE8 applies. It is considered that the proposed design of the bandstand and ornate railings would have a positive and enhancing effect to the bandstand that currently exists.

              The proposal is in line with Local Policy LT6, which seeks to retain and support schemes that are of a scale and character appropriate to the surrounding area do not have a detrimental impact on amenities.
              Conclusions

              The development hereby recommended for approval has been assessed against the Waverley Borough Local Plan 2002 Policies C5, D1, D4, D12, HE8 and LT6 and material considerations, including third party representations.
