The recommendations arising from this report will have little quality of life impact on the community and local environment as a whole, although the noise pollution caused to the owners of 2 Squirrels Close will be greatly reduced by the enclosure of the land that this purchase will allow, thereby increasing the quality of life of the residents concerned. The land is of no significant biodiversity value, of little value as a natural resource and the subsequent fencing of the land will be subject to planning requirements that will safeguard the visual appearance of the area. There will, however, be a small, but insignificant loss of open space.

There are no e-government implications associated with this report due to the nature of the recommendations.

Resource and legal implications:

The Council will obtain a capital sum for the sale (see (Exempt) Annexe).

It may be necessary to advertise the proposed sale and consider any objections received under Section 123 of the Local Government Act 1972.



1. The owners of 2 Squirrels Close, Binscombe, have asked to purchase the adjacent land which lies on the corner of Squirrels Close and Copse Side (see plan at Annexe 1. They have made this request as local youths are using their flank wall in connection with ball games, which has a detrimental effect on their quality of life. They propose to erect a fence and garden the land to prevent this activity occurring.

2. Proposed terms and conditions for the sale are set out below and in (Exempt) Annexe 2.

Recommendation (as contained in the previous report to the meeting on 3rd June)

It is recommended that, subject to any requirement to advertise the proposed sale and to consider any objections received under Section 123 of the Local Government Act 1972, the land shown hatched on the annexed plan be sold to the owners of 2 Squirrels Close, Binscombe on terms and conditions set out below and in the (Exempt) Annexe, other terms and conditions to be negotiated by the Property and Development Manager.

The use of the land is to be restricted to garden land or to parking vehicles whose use is ancillary to the use of 2 Squirrels Close as a single private dwelling.

Reconsideration of the proposal

The Executive to give further consideration to this proposal.
