This report seeks authorisation for the grant of an easement of vehicular access and services to a new property to be constructed from redundant farm buildings. There are no “Opportunities for All”, Community Safety or Human Rights implications. The resource and environmental implications are referred to in the report. The grant will provide Waverley with a capital sum and environmental implications have been considered under the grant of planning permission.

Summary and Purpose

This report seeks authorisation for the grant of an easement of vehicular access and services to a new property to be constructed from redundant farm buildings. There are no “Opportunities for All”, Community Safety or Human Rights implications. The resource and environmental implications are referred to in the report. The grant will provide Waverley with a capital sum and environmental implications have been considered under the grant of planning permission.

Introduction & Background

1. Permission was granted (WA00/2236) to convert redundant farm buildings at Gaston Gate Farm, Cranleigh into a dwelling with ancillary office/workshop as shown outlined on the plan at Annexe 1.

2. The existing access is shown coloured black. The proposed access for which planning permission has been granted is shown hatched. Both accesses cross Waverley-owned common land shown cross-hatched, for which there is no right of vehicular access. A deed of easement to the property is therefore required. The deed will be either for the route shown hatched or for the coloured black route, depending on the final requirements of the applicant. The easement will also be for services to the new property.

Resource/Environmental Implications

3. The environmental implications of the route shown hatched have been taken into account in the grant of the planning permission (WA00/2236). Planning permission would be required for the route coloured black, when the environmental implications would be considered.

4. The grant of a deed of easement would provide Waverley with a capital sum, as set out in (Exempt) Annexe 2.

Recommendation

It is recommended that an easement of access to a new property at Gaston Gate Farm be granted on terms set out in (Exempt) Annexe 2 to this report, other terms and conditions to be negotiated by the Property and Development Manager.
