Note pursuant to Section 100B(5) of the Local Government Act 1972
This report refers to exempt information by virtue of which the public may be excluded during the item to which the report relates, as specified in Paragraph 7 of Part 1 of Schedule 12A to the Local Government Act 1972, namely:-
Information relating to the financial or business affairs of any particular person (other than the authority).
1. Details of all cases shown below may be inspected by members prior to the meeting, on application to the Director of Finance.
2. The following sum is irrecoverable and is submitted to the Executive for write-off approval. Since the last meeting, these arrears, in respect of the categories set out below, total £12,136.23.
National Non-Domestic Rates
3. The above case relates to overpaid housing benefit due from a debtor. A number of arrangements were entered into with the debtor for the payment of this outstanding sum but no payments were received. Proceedings were taken in the County Court for the recovery of the debt resulting in the Council petitioning for the bankruptcy of the debtor. The debtor was declared bankrupt on 23rd October 2001. The Official Receiver has advised the Council that he does not intend to call a meeting of creditors and that he does not expect there to be any distribution of funds for the creditors.
4. In accordance with recommended accounting practise the Council maintains a provision for bad debts. This provision meets with audit requirements and is subject to annual review. The write-off in the table above is within the normal annual allowance for such items.
It is recommended that approval be given for the sum of £12,136.23 to be written off.
There are no background papers (as defined by Section 100D(5) of the Local Government Act 1972) relating to this report.
