Summary and Purpose

Waverley Borough Council is the Licensing Authority under the Riding Establishments Acts 1964 and 1970, and the purpose of this report is to determine an application for a licence to operate a riding establishment at The Haybarn, Dye House Road, Thursley. The proposals in this report do not have any "Opportunities for All" implications and administration of this application will be met by current resource levels.

Introduction

1. This Council is the Licensing Authority for the Waverley area for the purposes of the Riding Establishments Act 1964 and 1970 and has a responsibility to ensure that premises granted a licence under the Act conform to the conditions of licence as required in the legislation.

2. The Council’s veterinary surgeon inspects all riding establishments to ensure compliance with these conditions.

Details of Application 3. An application was received on 14th November 2002 from Mr Sam Robert Martin of Lynwood, Heath Road, Hammer, Haslemere to operate a riding establishment at The Haybarn, Dye House Road, Thursley.

4. The application for a Riding Establishment Licence is a completely new premise and there has not been a previous license from this Authority.

5. An inspection of the premises was carried out by the Council’s Veterinary Officer on 27th November 2002. At this time a number of recommendations were made by the vet, namely:-

· That the horses called Gallina, and Greta have been declared not suitable for use in the riding school by the veterinary officer and are not to be used;
· That there is a prominent notice forbidding smoking;
· That the contact details for the licensee are displayed;
· That the instructions as to action to be taken in the event of fire, with particular regard to the extrication of horses are displayed;
· premises should only be used for the purpose of giving lessons in riding and not for the hiring out of horses. 6. There is historical use of the premises over many years. The premises were re-inspected on 17th December 2002 by an officer of the Environmental Health Section, at which time the recommendations from the vet were found to have been implemented and the establishment was satisfactory.
Human Rights/Community Safety Implications

7. There are no Human Rights or Community Safety implications to this report.

Resource implications

8. Inspection charges and administration costs as a result of this application have been taken into account in the fee of £143.00 plus Vet’s fees, which have been paid by the applicant.

Environmental Implications

9. There are no environmental implications to this report

Options available to the Council

10. The options open to the Council are:

(a) to grant a licence (inclusive of standard conditions) to Mr Sam Martin to keep a riding establishment at The Haybarn, Dye House Road, Thursley.

(b) to refuse the application for licence on the grounds of:
(c) to withhold the licence on grounds of non compliance;

(d) to issue a temporary licence with specified conditions, to obtain compliance with standard and specified conditions within a reasonable timeframe.

Conclusion

11. The applicant, Mr Sam Martin, is not disqualified to hold a Riding Establishment Licence, and has paid the appropriate fee. The applicant has complied with current requirements for conditions following the Veterinary Officers original inspection.

Recommendation

It is recommended that a licence to operate a riding establishment be granted to Mr Sam Martin in relation to The Haybarn, Dye House Road, Thursley.
