17. MINUTES (Agenda Item 1)

The Minutes of the Meeting held on 26th July 2006 were duly confirmed and signed.

18. APOLOGIES FOR ABSENCE (Agenda Item 2)

Apologies were received from Mr W M Marshall, Mr P J Nicholson, Mr A Rayner, Mr J E Robini, Mr J R Sandy and Mr A E B Taylor-Smith.

19. DISCLOSURE OF INTERESTS (Agenda Item 3)

Mr M H W Band declared a personal interest arising from three items contained in the Planning Enforcement Quarterly Report (Agenda Item 6) as he lives close to the property concerned.

Mrs D M James declared a personal and prejudicial interest in WA/2006/1479 (Agenda Item B3) and a personal interest in WA/2006/0821 (Agenda Item B5) as she lives close to both applications concerned.

Mrs A E Mansell declared a personal interest in WA/2006/1665, 1666 and 1667 (Agenda Items A1 – A3), WA/2006/1553 (Agenda Item B4) and the Exempt report on Enforcement Action – Ball and Wicket Lane, Farnham (Agenda Item 10), as she is a Farnham Town Councillor.

The Assistant Solicitor (Laura Renaudon) declared a conflict of interest regarding the Exempt report on Enforcement Action – Ball and Wicket Lane, Farnham (Agenda Item 10) and withdrew from the meeting during discussion of that item.


20. PLANNING APPLICATION – WOODLANDS FARM (Agenda Item 7)

The Development Control and Policy Manager advised that it was proposed to withdraw the application in respect of Woodlands Farm, Ockley Road, Ewhurst (WA/2006/1479) as there were some procedural issues that required resolution before formal consideration by Committee.

RESOLVED that the application in respect of Woodlands Farm, Ockley Road, Ewhurst be withdrawn.

21. APPLICATIONS FOR PLANNING PERMISSION (Agenda Item 7)

RESOLVED that the applications for planning permission, as set out in the Schedule attached, be determined as shown in column 3 thereof.

22. LEGAL AGREEMENT – MULLARD SPACE SCIENCE LAB, ORATORY, HOLMBURY HILL ROAD, FOREST GREEN, DORKING (Agenda Item 7 B.5)
(See also application WA/2006/0821 in Schedule attached)

RESOLVED that planning permission WA/2006/0821 be GRANTED, subject to the making of a legal agreement (all costs to be met by the applicant), within 6 months, to secure the contribution to the cost of providing 3 passing places in Three Mile Road.

23. EXCLUSION OF PRESS AND PUBLIC

RESOLVED that, pursuant to Procedure Rule 20 and in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of the following item on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the public were present during the item, there would be disclosure to them of exempt information (as defined by Section 100I of the Act) of the description specified in the revised Part 1 of Schedule 12A to the Local Government Act 1972 namely:-

24. ENFORCEMENT ACTION – BALL AND WICKET LANE, FARNHAM (Agenda Item 10)

The Committee received and considered a report on whether variations to the approved plan were acceptable or not, and whether enforcement action should be instigated.

RESOLVED that, subject to the Head of Legal Services being satisfied with the evidence,

1. enforcement action be instigated under the Town and Country Planning Act, and associated legislation, to ensure that conditions giving the effect of Conditions 2, 3, 6 and 7 of planning permission WA/2005/0943 be implemented, plus a condition to ensure that the shower room, closet/walk-in wardrobe and landing windows should be obscurely glazed;

2. enforcement action be taken to ensure that the guide wire to the telegraph pole at the front of the property be relocated outside of the driveway and parking areas; band

3. enforcement action be taken to require the timber fence on the north-west boundary to be replaced with a brick wall, as indicated on the original approved application drawings.
