To receive from Members, in relation to any items included on the agenda for this meeting, disclosure of any interests which are required to be disclosed by Section 94(1) of the Local Government Act 1972 and in accordance with the Waverley Code of Local Government Conduct.

FORWARD WORK PROGRAMME
5.
EXECUTIVE FOUR-MONTH ROLLING PROGRAMME

To receive the Four-Month Rolling Programme of key decisions, which was considered by the
Executive
at its
meeting

6th September 2004,
attached as
Appendix A
, and to identify any issues which the Committee would wish to have sight of before they are considered by the Executive.

COMMITTEE WORK PROGRAMME: IN-DEPTH REVIEWS

It was agreed at the meeting on 16th March 2004 that the items to be included on the work programme for 2004/05 for in-depth reviews would be:-
(i) Development Control; and
(ii) Promoting Youth Activity in Sport and Countryside Pursuits
WORK PROGRAMME ITEMS
REVIEW OF DEVELOPMENT CONTROL
As part of this Committee's review of the Development Control Service in Waverley, it was agreed, that a Sub-Committee be established to conduct interviews with planning and other staff. The Review of Development Control Overview and Scrutiny Sub-Committee is due to meet on Thursday 9th September and Monday 13th September.
7.
PLANNING BEST VALUE PERFORMANCE INDICATORS: FIRST QUARTER OF 2004/05

This Committee, as part of its review, also wished to monitor performance against the best value performance indicators (BVPIs) that measure the speed with which Waverley decides planning applications. The report at
Appendix B
gives details of performance against those BVPIs for the quarter ending 30th June 2004. The data shows an improvement in performance.
Recommendation
It is recommended that this Committee notes the report and agrees any observations to be forwarded to the Executive.
OVERVIEW ISSUES
8.
LOCAL DEVELOPMENT FRAMEWORK SCHEME

The Local Development Framework Special Interest Group is considering the final draft of the Local Development Scheme at its meeting on the 2nd September. This is the document which sets out the programme management plan for producing the Local Development Framework. A report on the outcome of that meeting is
to follow.
The purpose of this report at
Appendix C
is to set out the background to the new system and explain the work that the Local Development Framework Special Interest Group has undertaken in producing the Local Development Scheme.
The Planning and Compulsory Purchase Act, which received Royal Assent on 13th May 2004 (the 2004 Act), provides for a new system for the production of development plans. It is anticipated that the Commencement Orders and the final draft of the Regulations will be published in September.
The current system of Structure Plans (prepared by County Councils), Unitary Plans (prepared by Unitary Authorities) and Local Plans (prepared by District/Borough Councils) is to be replaced with a system of Regional Spatial Strategies (prepared by the Regional Assemblies) and Local Development Frameworks (prepared by Local Planning Authorities).
Whilst the Government has not yet issued the Commencement Orders nor has it issued the final draft of the Regulations, the anticipated timetable for the production of these new documents is very tight. Local authorities are therefore being urged to make a start on the preparation of the documents at an early stage.
Recommendation
It is recommended that the Environment and Leisure Overview and Scrutiny Committee forward its comments to the Executive prior to the Local Development Scheme being adopted by Council and submitted to the Government Office by December.
9.
STATEMENT OF COMMUNITY INVOLVEMENT

The Local Development Framework Special Interest Group is considering the second draft of the Statement of Community Involvement (SCI) at its meeting on the 2nd September. A report on the outcome of that meeting is

explains the work that the Local development Framework Special Interest Group has undertaken in producing the Statement of Community Involvement.
Waverley has to introduce the Statement of Community Involvement as part of the Local Development Framework. The purpose of the Statement is to show how the Council intends to consult the community, build consensus and engage stakeholders and the public in producing the Local Development Framework.
Recommendation
It is recommended that the Environment and Leisure Overview and Scrutiny Committee forward its comments to the Executive for endorsement prior to it being published for consultation.
SCRUTINY ISSUES
10.
WAVERLEY CULTURAL STRATEGY REVIEW

The report at
Appendix E
provides Members with an update on the progress made to date in delivering the action plan associated with the Waverley Cultural Strategy. The Council adopted the Waverley Cultural Strategy, A Blueprint for Leisure, in February 2003. The strategy set out the vision and direction for the development of cultural services, facilities and activities within the Borough over a five year period.
Recommendation
It is recommended that any views and observations
on the Cultural Strategy action plan update be passed on to the Executive.
11.
DRAFT WAVERLEY BOROUGH CYCLING PLAN

The purpose of this report at
Appendix F
is to authorise an updated Cycling Plan to go out to public consultation. The Plan has been produced in conjunction with the Waverley Cycling Forum. It has recently been amended following the comments made by the Environment and Leisure Overview and Scrutiny Committee in April and endorsed by the Executive in June. This report concentrates on the comments of the Waverley Cycling Forum in response to the resolution of the Executive, and the changes that have been made to the Draft Plan. The Draft Cycling Plan and its associated annexes are attached to the report.
Recommendation
It is recommended that the Draft Waverley Borough Cycling Plan be approved as a basis for public consultation.
12.
REVIEW OF FLY TIPPING
A report on the outcome of the in-depth review into fly tipping in Waverley, which was conducted by this Committee, is being considered by the Executive at its meeting on 6th September 2004. The views of the Executive on the proposed way forward
will follow as Appendix G
.
13.
EXCLUSION OF PRESS AND PUBLIC
To consider the following recommendation on the motion of the Chairman:-
Recommendation
That, pursuant to Procedure Rule 20, and in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of the following item on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the public were present during this item there would be disclosure to them of exempt information (as defined by Section 100I of the Act) of the description specified in the appropriate paragraph(s) of Part I of Schedule 12A to the Act (
