Title:
AMENDMENT TO DELEGATION SCHEME.

Summary and purpose:

This report suggests an amendment to the delegation scheme following the consideration of the issue by the Modernising Planning Special Interest Group as set out in the main report. The Executive is asked to consider the amendment and recommend it to Council.

Resource and legal implications:

The are no direct legal implications arising from this report. The refinement of the delegation scheme is likely to marginally reduce the committee business by removing applications that Members consider do not warrant a decision at a Development Management Committee.


1. Members of the Modernising Planning Special Interest Group expressed some doubt about the need to report applications for renewals or for amendments to previous approved schemes to the Development Management Committees for a decision. This was thought particularly to be the case where the principles of development had already been established and the application under consideration was so similar that it would be difficult for the Committee reasonably to come to a different conclusion. An amendment to the delegation scheme to authorise the Director of Planning and Development to grant such applications was supported.

2. Officers have talked to the Planning Portfolio and Shadow Planning Portfolio Holders about an appropriate paragraph to be added to the delegation scheme.

3. The Executive is therefore asked to consider the additional delegated power as set out below and make a recommendation to Council.

4. Proposed amendment to delegated powers to Director of Planning and Development.

Authority, where applications for renewal of, or amendment to a previously approved application are for a development sufficiently similar to the previously approved development, to grant such applications provided that, in the opinion of the Director of Planning and Development

1. There are no material change in circumstances from that at the time of the original decision, 2. Any variations or amendments contained in the application under consideration are minor or small scale in nature; and 3. The development is not in conflict with the Council’s planning policies.
