MINUTES OF THE LICENSING SUB-COMMITTEE MEETINGS
The Licensing Act 2003 Sub-Committees ‘A’-‘E’ are now meeting infrequently and some minutes from previous meetings have yet to be signed by the Chairmen. The Committee is asked to authorise the Chairmen of the Sub-Committees to sign outstanding minutes in order they may be released into the public domain.
It is recommended that the Committee authorise the Chairmen of Licensing Act 2003 Sub-Committees ‘A’-‘E’ to sign outstanding minutes in order they may be released into the public domain.
REVIEW OF STREET TRADING

To receive the report on the Review of Street Trading from the Licensing (General Purposes) Sub-Committee held prior to this meeting. The report will be circulated at the meeting and is expected to make a recommendation to the Licensing and Regulatory Committee.

LICENSING ACT 2003 – APPEALS UPDATE

In accordance with a request from Committee Members to be kept informed of the situation regarding appeals, the following has been submitted to date to the Magistrates’ Court against the Council’s decision on the following premises, licence/club premises certificate applications:
Bramley Social Club – Hearing on 30th March 2006
Further to the decision of the Licensing (General Purposes) Sub-Committee on 2 March 2006 authorising the Solicitor to the Council to enter into negotiations with the Bramley Social Club over the removal of certain conditions attached to its Club Premises Certificate, it is confirmed that those negotiations took place during March 2006 and an agreement was reached between the Club and the Council. The terms of that agreement are as follows:-
The conditions attached to the licence granted by Waverley Borough Council are be amended in the following respects:
1. to remove the condition 2 prohibiting "off-sales";
2. to remove condition 4 requiring a personal licence holder who must be a point of contact for Surrey Police; and
3. to remove condition 5 recommending that a Steward be appointed, and to replace with a new condition 2 that a Bramley Social Club Committee member be the designated point of contact for Surrey Police.
4. That there be no order as to costs against the Council.
As a result of that agreement being reached the Council and the Club signed a Consent Order before the Magistrates' Court on 30 March 2006. The terms of that Consent Order are as listed in paragraphs 1 to 4 above. The local residents and Police were informed of the terms of the agreement prior to the hearing on 30 March.
It is recommended that the above situation regarding appeals be noted.
