Summary & Purpose

There are unlikely to be any significant social, environmental or economic implications associated with this report due to the nature of the recommendations and the site concerned. There may, however, be some positive local environment implications as the appearance of the land may improve when it is maintained by the owners of 42 Cherry Tree Lane as part of their property.

There are no e-government implications associated with this report due to the nature of the recommendations.

Resource and legal implications:

It may be necessary to advertise the proposed sale and to consider any objections received under Section 123 of the Local Government Act 1972. A sale would provide a capital sum for the Council.

1. 42 Cherry Tree Lane, Godalming, is a former Council House. Adjoining the property is an open area which is surfaced with rough tarmac and separated from the communal lawn by a low brick wall. There is no vehicular access to the land.

2. The Council has been contacted by the owners of the house with a request to purchase the land shown outlined on the plan at Annexe 1 for garden purposes.

3. A sale of land for similar use and of similar size has taken place on the estate adjacent to 52 Cherry Tree Lane. When the sale of this land took place in 2000, advice from the Planning Officers was that, although the area in question may have been sufficient to accommodate a further dwelling, because of the high density of development on this estate, encroachment upon a tract of open land within the estate would not be desirable.

Conclusion

4. Proposed terms and conditions for the sale of this land are set out below and in (Exempt) Annexe 2. It would appear that the sale of this land would not greatly affect the Council’s land holdings in this area while assisting the owners of 42 Cherry Tree Lane.

Recommendation (as contained in the previous report to the meeting on 3rd June)

It is recommended that, subject to any requirement to advertise the proposed sale and to consider any objections received under Section 123 of the Local Government Act 1972, the land outlined on the annexed plan be sold to the owners of 42 Cherry Tree Lane, on the terms and conditions set out below and in the (Exempt) Annexe.

Reconsideration of the proposal

The Executive to give further consideration to this proposal in the light of information gathered at the site visit held on 17th June.
