COUNCIL MEETING – WEDNESDAY, 26TH APRIL 2006

A Meeting of the WAVERLEY BOROUGH COUNCIL will be held in the COUNCIL CHAMBER, COUNCIL OFFICES, THE BURYS, GODALMING on WEDNESDAY, 26TH APRIL 2006 at *7.00 pm and you are hereby summoned to attend such meeting.

To approve as a correct record the Minutes of the Meeting of the Council held on 21st February 2006 (herewith).

2. APOLOGIES FOR ABSENCE

The Mayor to report apologies for absence.

3. DISCLOSURE OF INTERESTS

To receive from Members declarations of personal and prejudicial interests in relation to any items included on the agenda for this meeting in accordance with the Waverley Code of Local Government Conduct.

5. QUESTIONS FROM MEMBERS OF THE PUBLIC

To answer the following question received in accordance with Procedure Rule 10 from Mr Murphy of Farnham:-

"From the appointment of Crest Nicholson Sainsbury as the chosen commercial partners of WBC for the so-called East Street redevelopment, the Traffic Management Group of the Farnham Society has repeatedly asked for details of the traffic and parking provision needed to accommodate the proposed development. In November, we were promised we would receive the same briefing that was being given to groups of councillors by the schemes traffic consultants. Although the promise was renewed earlier this year, we are still waiting.

Following the resolution of WBC on 19th December last year, we expect a planning application on or by 1st May, this year. If the Council's resolution is to be executed in the time remaining, the full traffic impact assessment should be completed.

May we now have sight of this document, so that we can have a full and proper understanding of the provisions and their anticipated impact on our town, in order to contribute in a useful and meaningful way to the debate?"

6. MINUTES OF THE EXECUTIVE AND COMMITTEES

(a) To receive the minutes of the meetings of the Executive held:-

(i) on 7th March 2006 (herewith – coloured grey);

(ii) on 4th April 2006 (herewith - coloured grey);

(iii) on 18th April 2006 (to follow); and

(iii) on 24th April 2006 (to be tabled).

(b) To receive the minutes of the meeting of the Standards Committee held on 3rd March 2006 (herewith – coloured buff); and

(c) To receive the minutes of the meeting of the Licensing and Regulatory Committee held on 11th April 2006 (herewith – coloured aqua).

7. LOCAL GOVERNMENT AND HOUSING ACT 1989
LOCAL GOVERNMENT (COMMITTEES AND POLITICAL GROUPS) REGULATIONS 1990

7.1 The Council is under duty to review the allocation of seats on principal Committees, namely the three Overview and Scrutiny Committees and the Regulatory Committees, i.e. the Licensing and Regulatory Committee and the Joint Planning Management Committee, as soon as practicable after the recent by-election in the Ewhurst Ward. The election of Mrs D M James to the Council and her membership of the Independent Group changes the political proportionality. Calculations giving the new allocation of seats are set out below.

7.2 The following three groups are registered under the provisions of the Local Government Housing Act 1989. The political breakdown of the Council is as follows:

7.3 To calculate the allocation of seats on principal Committees, it is necessary to proceed as follows:-

(i) Total number of seats on all relevant Committees – 154

(ii) Proportion that each registered political group forms of the total membership of the Authority in accordance with the above registration:-

Recommendation

It is recommended that

1. the Council formally resolves that the seats on the principal Committees listed be allocated as shown above; and

2. appointments be made to the Executive and Committees based on the list to be circulated.

8. EXCLUSION OF PRESS AND PUBLIC

To consider the following motion, to be moved by the Mayor, where appropriate:-

That pursuant to Procedure Rule 20 and in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of any matter on this agenda on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the public were present during the item(s), there would be disclosure to them of exempt information (as defined by Section 100I of the Act) of the description specified in the appropriate paragraph(s) of Part I of Schedule 12A of the Local Government Act 1972.
