Summary and Purpose

Waverley Borough Council is the Licensing Authority under the Riding Establishments Acts 1964 and 1970, and the purpose of this report is to determine an application for a full licence to operate a riding establishment at Old Park Stables, Old Park Lane, Farnham. The proposals in this report do not have any “Opportunities for All” implications and administration of this application will be met by current resource levels.

Introduction

1. This Council is the Licensing Authority for the Waverley area for the purposes of the Riding Establishments Act 1964 and 1970 and has a responsibility to ensure that premises granted a licence under the Act conform to the conditions of licence as required in the legislation.

Details of Application

2. An application was received on 15th November 2002 from Mr Carl Belson of Old Park Stables, Old Park Lane, Farnham, Surrey, to operate a riding establishment at this address.

3. The premises were inspected by the Council’s veterinary surgeon to ensure compliance with the conditions of licence.

4. This application for a Riding Establishment Licence came before this Committee on 13th January 2003, when a three month temporary Licence was granted, the horses to be used in the premises had not been delivered to the premises and therefore were unable to be inspected by the Council’s Veterinary Officer.

5. The temporary licence expires on 13th April 2003 and the licence now needs to be either renewed or made a full licence, or refused.

6. The horses were subsequently inspected by the Veterinary Officer on 14th January 2003 and were found to be satisfactory for use in the establishment.


7. The premises have been re - inspected by an officer of the Council who confirms that compliance with the conditions is still being met.

8. The Planning Officers have confirmed that there are no planning implications relating to this application.

9. The establishment owner has previously held a licence to operate a riding establishment at these premises for many years and the new operator is not required to seek planning permission.

Human Rights/Community Safety/Environmental Implications

10. There are no implications in this report under this heading.

Resource implications

11. Inspection charges and administration costs as a result of this application have been taken into account in the fee of 255 plus Vet’s fees, which has been paid by the applicant.

Options available to the Council

12. The options open to the Council are:-

(a) to grant a full licence (subject to the standard conditions and special condition referred to at Annexe 1) to the applicant to keep a riding establishment at Old Park Stables, Old Park Lane, Farnham, Surrey;

(b) to refuse the application for licence on the grounds of:-

(i) disqualification of the applicant from keeping a riding establishment or custody of any animal;

(ii) non payment of fee; or

(iii) non compliance with the specified conditions; or

(c) to withhold the licence on grounds of non compliance.

Conclusion

13. The applicant, Mr Carl Belson, is not disqualified to hold a Riding Establishment Licence, and has paid the appropriate fee and complies in full with the conditions of licence.

Recommendation

It is recommended that a full licence to operate a riding establishment be granted to Mr Carl Belson in respect of Old Park Stables, Old Park Lane, Farnham, Surrey.
