Description of Site/Background

The Farnham Pottery site is located between Pottery Lane and Quennell’s Hill in Wrecclesham. The complex is Listed and is also within the Conservation Area. The site is presently owned by the Farnham Building Presentation Trust Limited.

The Trust is gradually restoring the semi-derelict pottery buildings and letting small workshops to individual craftworkers as and when usable space becomes available (original permission reference WA00/0693). The Harris Pottery business ceased in 2000.

In April 1996, planning permission was granted for a change of use of the first floor of one of the pottery buildings, adjacent to Pottery Lane, to provide a staff flat. The permission was subject to both a planning condition and a legal agreement limiting the residential use to purposes ancillary to the pottery business.

The Application

An application has been made by the Trust to discharge the planning agreement that was attached to that earlier planning permission (reference WA92/1243). It considers that because there is no longer a single pottery business employing staff on the site, there has been a material change in circumstances and the legal agreement is no longer necessary.

The Trust states that it has carried out many improvements to the flat. It states that the flat is now completely self-contained, with a new lobby provided at the main entrance, separating the door and staircase to the flat from the workshop below it. It also states that the second entrance to the flat, which previously connected it to the pottery showroom, has been removed. It adds that the staircase leading down to the showroom has been removed and the space floored over, giving extra space in the utility room. It also states that the flat itself has been refurbished (new windows, carpet, etc.)

Main Issues

The main issue is whether there has been a change in circumstances such that this Obligation is no longer necessary.

When planning permission was originally granted it was felt, that given the location, and limited amenity available to the flat, it would not be suitable as general housing and should be only available as a staff flat.

Circumstances at the site have changed and officers support the efforts of the Trust to upgrade buildings and make available a number of small units for craftspeople. Having regard to the present circumstances, it would not be unreasonable to allow this part of the building to have the potential either for use as residential accommodation by one of the crafts people or as a small independent flat. It has its own access and can function as a small separate unit without unduly comprising amenity.

Your Sub-Committee

RECOMMENDS that

11. the request to discharge the planning obligation attached to planning permission reference WA92/1343 be AGREED and that an Agreement to discharge the original Deed be completed at the applicant’s expense, the Council’s costs also to be borne by the applicant.

1. The applicant is reminded that, in order to use the flat independently, it will also be necessary to make a separate application to remove the condition attached to planning permission reference WA92/1343.
