Summary & Purpose
1. The purpose of the report is to enable the Sub-Committee to consider an application from Alfold Sports Council Social Club, which wishes to vary its existing Club Premises Certificate under the Licensing Act 2003, where a representation has been received.

LICENSING ACT 2003 - VARIATION OF A CLUB PREMISES CERTIFICATE - ALFOLD SPORTS COUNCIL SOCIAL CLUB, THE PAVILION, RECREATION GROUND, DUNSFOLD ROAD, ALFOLD GU6 8JB

Summary and Purpose

1. The purpose of the report is to enable the Sub-Committee to consider an application from Alfold Sports Council Social Club, which wishes to vary its existing Club Premises Certificate under the Licensing Act 2003, where a representation has been received.

Activities sought under the variation application

2. An application to vary the certificate has been made. The application before the Sub-Committee seeks to extend the hours of the licence and to add activities which are not currently in the licence.

3. The detail of the application, together with a summary of the existing licence, is set out in Annexe 1, including non-standard timings. The application is also outlined below:
Supply of Alcohol: (Box L) Sunday, Monday and Thursday 1000 - 2300, Tuesday, Wednesday, Friday and Saturday 1000 - 0100
Hours the premises are open: (Box M) As for the sale of alcohol, closing 30 minutes later
Steps to meet the Licensing Objectives - are also attached - Box P.

4. A letter of clarification is also attached, which explains that the club will only operate the hours requested on a maximum of up to 20 days per year, and in accordance with Club Rules. For the remainder of the year, apart from these 20 dates, the premises will cease entertainments and supply of alcohol at 2300, and will close at 2330 at latest.

Licensing Objectives

5. The four Licensing Objectives of the Licensing Act 2003 are set out below. Any representations for consideration must relate to one or more of these objectives.

Prevention of Crime and Disorder
Public Safety
Prevention of Nuisance
Protection of Children from Harm


Representations received

6. The Responsible Authorities have not made representations on this application, although the application has been modified as a result of discussion with the Surrey Police. The Environmental Health Section has proposed the following condition, which has been agreed with the applicants:

Condition
External doors and windows shall be kept closed while events involving amplified, live or recorded music are taking place, and after 2200 every day.

7. One letter of objection has been received from a local resident (interested party) within the 28-day representation period, shown at Annexe 2. 8. Attached to this document at Annexe 3 is a plan showing the site of the premises and the surrounding area.

What the Sub-Committee may do

9. The Sub-Committee will hear from the applicant and the objector. Having heard from each party, it may take any of the following actions, giving its reasons for so doing:

Refuse the application to vary (the existing licence will then continue unmodified)
Modify the requested hours and/or activities
Apply conditions to the varied licence (to meet the concerns raised in the hearing)
Grant the application as requested

Subsequent Developments in this Application Procedure

10. Any further amendment to the application submitted to the Licensing Officer will be circulated to Members prior to the meeting.

Recommendation

It is recommended that the application to vary the club premises certificate for Alfold Sports Council Sports Club, The Pavilion, Dunsfold Road, Alfold be determined in the light of the representation received, the Licensing Objectives and Waverley’s Statement of Licensing Policy and after hearing from the applicant and the interested party making representation.
