9. LICENSING ACT 2003 – APPLICATION FOR REVIEW OF A PREMISES LICENCE – CO-OP WELCOME, 40 GREEN LANE, FARNCOMBE
[Wards Affected: Godalming Binscombe]

9.1 The Trading Standards Officer (the Applicant) brought three test purchase cases to the attention of the Sub-Committee. The legal representative for the Co-Op Welcome (the Premises Licence Holder) said that they had not received details of the third test purchase case (on 6th September 2007) and as they had not had time to consider this case it should not be included in the hearing. They were also concerned that some information was missing from their agenda papers.

9.2 The legal representative for the Premises Licence Holder had submitted a bundle of papers to support their claim that they had acted with due diligence. The Applicant had not had sight of these papers and was not prepared to consider them until he had an opportunity to study them.

9.3 The Assistant Solicitor to the Council advised the meeting that additional evidence submitted at the meeting could either be (i) considered at the hearing with the consent of all parties, (ii) not considered at all and the meeting be adjourned, or (iii) the additional evidence admitted after all parties had had the opportunity to consider it.

9.4 Following discussion, the Sub-Committee agreed to adjourn the meeting for one hour to allow all parties to consider the additional evidence.

9.5 The meeting resumed and it was

RESOLVED that the application for a review of the premises licence at the Co-Op Welcome, 40 Green Lane, Farncombe be deferred until a date to be agreed to allow all parties to further consider the additional evidence.


The meeting commenced at 12.25 pm and concluded at 2.29 pm.
