The annexe to this report contains exempt information by virtue of which the public is likely to be excluded during the item to which the report relates, as specified in Paragraph 9 of Part I of Schedule 12A to the Local Government Act 1972 viz:-

Summary and purpose:

This report seeks Authorisation for a 10 year lease of the cricket square and site of pavilion at Broadwater Park, shown hatched on the plan annexed, to Farncombe Cricket Club.

Quality of life implications – social, environmental & economic (sustainable development):

Farncombe Cricket Club is a major user of the facilities at Broadwater Park. The lease would bring its use of facilities in line with other users at the park.

E-Government implications:

There are no e-government implications.

Resource and legal implications:

The grant of the lease will give Waverley an annual payment on terms set out in the (Exempt) Annexe to this report.

Whilst the club has an existing lease with security of tenure for the cricket pitch, a lease of the ground on which the pavilion is constructed will bring it into line with the other clubs at Broadwater.

Background

1. Farncombe Cricket Club has had a lease of the cricket square at Broadwater Park for at least 19 years. As its previous lease was for 10 years, it has a right to renew that lease for a period of a further 10 years. The club also has a pavilion and shed which it constructed itself. There is no lease for the ground on which these buildings were constructed. It would appear sensible, therefore, to arrange for a new lease of the cricket square to include the other areas occupied by the club. The proposed terms and conditions are set out in the (Exempt) Annexe to this report.

2. Whilst the 2001 Broadwater Park Master Plan identified a possibility of relocating all pavilions into a single building, this recommendation was met with resistance from the Clubs and has not been pursued. The proposal in this report does not prejudice the long term plans for the park.

Recommendation

It is recommended that a 10 year lease of the cricket square and sites of pavilion and shed at Broadwater Park be granted to Farncombe Cricket Club on terms and conditions as set out in the (Exempt) Annexe, other terms and conditions to be negotiated by the Property and Development Manager.
