Prior to the start of the meeting Surrey County Council Trading Standards (the applicant) met with the legal representatives of ROC UK Ltd (the Premises Licence Holder) and Surrey Police.

These discussions lead to the proposal to add three conditions to the current licence, to which all parties agreed, and which alleviated the current concerns of Surrey County Council Trading Standards and Surrey Police.

7. LICENSING ACT 2003 – APPLICATION FOR REVIEW OF A PREMISES LICENCE – ESSO HASLEMERE, JUNCTION PLACE, HASLEMERE
[Wards Affected: Haslemere Critchmere and Shottermill]

7.1 The Licensing Officer introduced the application for review of the premises licence.

7.2 The Trading Standards Officer advised the Sub-Committee that the review had been requested following three test sales of alcohol to under-age children at the premises. However, following discussion with the legal representatives for the Premises Licence Holder and Surrey Police prior to the commencement of the meeting, conditions had been proposed that he considered would resolve their concerns and which had been agreed by all parties. The Trading Standards Officer considered these conditions to be a sufficiently robust approach and Surrey Police also agreed that these conditions would satisfy their concerns on the management and control of this premises.

7.3 The proposed conditions were displayed to the meeting:-

1. A further personal licence holder to be employed to work at these premises and at least one personal licence holder to be on the premises at any time and at all times after 4.00 pm if alcohol is being sold. If there is no personal licence holder on the premises after 4.00 pm the alcohol section will be closed and no alcohol will be sold;

2. All staff employed at this store will be retrained in the next three months (from today’s date) and copies of their training records will be supplied to the Licensing Authority, the Police and Trading Standards; and

3. No alcohol sales to be made after 7.00 pm on Fridays and Saturdays.

7.4 All three parties also agreed to meet in three months’ time to consider the impact and effect, if any, that the three conditions were having and to take further action if it was considered necessary. This might include reviewing the hours that alcohol is sold.

7.5 The Trading Standards Officer advised the Sub-Committee that they would not seek revocation of the Premises Licence should the proposed conditions be acceptable to the Sub-Committee.

7.6 The Sub-Committee then withdrew and following their deliberation the meeting resumed.

7.7 The Sub-Committee was satisfied that ROC UK Ltd would be promoting the four Licensing Objectives by agreeing to the three conditions proposed by the applicant and agreed by all parties. The Sub-Committee expressed concern that the sale of alcohol up to 23.00 hours on Christmas Eve and New Years Eve may present some issues surrounding crime and disorder and therefore considered it helpful if adequate staff training could be completed before the festive season.

RESOLVED that the conditions, as amended and stated at item 7.3 above, be approved and added to the Premises Licence at Esso Haslemere, Junction Place, Haslemere
