Summary and Purpose

This report seeks authorisation for the sale of a small area of Council owned open space to the adjoining landowners for the purposes of using it as an extension to their garden. The proposal would affect the appearance of the estate and would provide the Council with a small capital sum.

There are no “Opportunities for All “ implications. The community safety implications arising from this proposal are included in this report.

Background

1. The land in question, which is amenity open space held by the General Fund, is shown hatched on the attached plan and has an area of about 21 square metres. It is situated near to a streetlight and is used as a shrub bed.

2. The owner of the adjacent property requested to purchase the land for the following reasons:

a. the shrubs within the bed are large, affecting the foundations of his property and patio and interfering with his parking space;

b. the land is a meeting point for local teenagers, who can be very noisy, banging on the wall of the house and leaving litter in the shrub bed which the adjacent owner cleans up on a regular basis; and

c. If he were permitted to purchase the land he would fence it in, thereby reducing both the nuisance of the overlarge shrubs and that of the group of teenagers.

Resource/environmental implications

3. There would be a small capital sum due to the General Fund for the sale of the land. The grounds maintenance contract would also be reduced by a small sum.

4. The sale of the land, subject to terms and conditions imposed and set out in the (Exempt) Annexe, would remove a shrub bed which has proven to be a nuisance to the adjacent owner and possibly to the remainder of the estate. It would also remove a small area of open space within this built up area.

Conclusion

5. The present use of the land shown outlined on the attached plan has proven to be a nuisance to the adjoining landowner. He has requested to purchase it both to remove the nuisance and to increase his garden area, which is very small. The land does not contribute greatly to the amenity of the estate and its loss could prove beneficial.

Recommendation

It is recommended that the land shown hatched on the attached plan be sold to the owner of 10 Windrush Close on the terms and conditions shown in the (Exempt) Annexe.
