Resource and legal implications:

The budget for Members’ basic and special responsibility allowances is 151,000 in 2004/05. The 2003 Independent Panel’s report recommended a scheme which increased the total cost by 28,000. The Council rejected this on the basis of the exceptional budget pressures in 2004/05. A Panel review of the scheme costs 2,500 plus staff time. This figure is included in the 2004/05 revenue budget.

Background

1. In accordance with the Local Authorities (Members’ Allowances)(England) Regulations 2003, Waverley has established an Independent Panel to consider its scheme of Members’ allowances. The Panel will review the scheme when the Council decides, the Panel’s last review being in 2003. In December 2003, the Council proposed that a further review be undertaken by the Panel in Autumn 2004.

The Allowances

2. In December 2003, the Council agreed to freeze the current levels of basic and special responsibility allowances in 2004/05, subject only to an inflation increase based on the local staff pay award from 1st April. The rates for Member’s travel reimbursement was agreed to be
in line with the National Joint Council rates, as amended each year.

3. If the Council decides not to undertake a full review of the scheme in 2004, Members may wish to consider separately the allowances of
the Chairman and Vice-Chairman of the Licensing and Regulatory Committee and the Licensing (General Purposes) Sub-Committee,
given the additional responsibilities of this Committee and Sub-Committee from April 2005. Currently, the Chairman and Vice Chairman
of the Licensing and Regulatory Committee receive a special responsibility allowance of 450 and 225 respectively. The table of
Members’ Allowances is included at Annexe 1 for information. This minor change could be agreed without the necessity of a full
Independent Panel review.

4. In view of the requirements of the new licensing regime, which will be introduced early next year, it is envisaged that small Sub-Committees of three members will be convened to consider liquor licence applications. These member groups will be drawn from the Licensing and Regulatory Committee. Given that they will be called to meet on a random basis and as a random selection of members, it is not proposed that any further arrangements need to be made for the Chairman of these groups to receive a Special Responsibility Allowance.

Recommendation

That the Executive recommends to Council:

1. whether to request the Independent Panel to undertake a review of Waverley’s scheme of Members’ Allowances in 2004; and

if not,

2. whether it considers that the Licensing and Regulatory Committee (and its General Purposes Sub-Committee) special responsibility allowances should be changed and, if so, to what amount; and

3. subject to 2, to freeze at current levels the basic and special responsibility allowances, subject only to an inflation increase based on the local staff pay award from 1st April 2005.
