OBSERVATIONS FROM THE LICENSING AND REGULATORY COMMITTEE – 1ST DECEMBER 2005

LICENSING ACT 2003 – FUTURE ENFORCEMENT, STAFFING STRUCTURES AND OTHER MATTERS
Your Committee received and noted proposals for continuing the licensing service to administer 2003 Act licences and for pro-active joint enforcement with Surrey Police.
Your Committee endorsed proposals for a largely reactive enforcement service, which would not involve an immediate late night or early morning response by Waverley staff to any complaints.
The introduction of the Licensing Act 2003 gives powers and duties to the Borough Council in its new role as Licensing Authority to enter, inspect and enforce conditions at licensed premises and in respect of personal licence holders and Designated Premises Supervisors. Accordingly, the Committee is recommending to the Council that officers be authorised in accordance with the Licensing Act 2003.
There are considerable resource implications following the transfer of responsibility for liquor licensing and the Committee has asked officers to carefully monitor this continuing workload and report on it on a regular basis.
In order to manage the increased workload, the Committee recommends that the current two-year Temporary Licensing Administrator post be made permanent.
Your Committee has also agreed to commend the following recommendations to the Executive.
The Executive is recommended to RECOMMEND to the Council that the following staffing proposals be agreed:
(a) to make the Temporary Licensing Administrator post permanent;
(b) continue the Temporary Licensing Administrator 0.7 part time post and the temporary enhancement of the Licensing Enforcement Officer post hours by 0.3 full-time equivalent; and
(c) to adopt the staffing structure set out in (Exempt) Annexe 2 of the report and resulting re-designations and re-evaluations of grading.
