DISCLOSURE OF INTERESTS
To receive from members, in relation to any items included on the agenda for this meeting, disclosure of any interests which are required to be disclosed by Section 94(1) of the Local Government Act 1972 and in accordance with the Waverley Code of Local Government Conduct.

RENEWAL OF ANNUAL PUBLIC ENTERTAINMENT LICENCE – THE THREE LIONS PUBLIC HOUSE, FARNCOMBE
[Wards Affected: All Godalming Wards]
Members will recall that there was a hearing on the annual application for renewal of the licences for the Three Lions Public House, Meadrow, Farncombe, when this matter came before this Committee in October 2002. At that time the Committee agreed to grant the licences requested for a six-month period only (to 30th April 2003), to operate on certain days of the week only, and that the works contained in the applicant’s consultants’ report should be carried out during that period, so that a further application could be submitted for the ensuing six-month period to the end of the annual Licensing year (30th October 2003). The purpose of the report at
is for the Committee to determine an application now received for renewal of the public entertainment licences for The Three Lions in for second half of the licensing year (i.e. from 1st May 2003 to 31st October 2003).
At the time of writing, the report has no significant environmental or “Opportunities for All” implications and payment of the fees for the licences contributes to the resource implications.
It is recommended that the Committee gives consideration to the special conditions previously imposed, as set out at Paragraphs 7 and 8 above, and, subject to this and to satisfactory completion of any items of repair which may be required to ensure that the premises meet the standards laid down in the Council’s Regulations and General Conditions, including the maximum number of persons to be admitted, the application for Music and Dancing and Sunday Music and Dancing Public Entertainment Licences at The Three Lions, Meadrow, Farncombe, be granted.
APPLICATION FOR FULL LICENCE TO OPERATE A RIDING ESTABLISHMENT – OLD PARK STABLES, FARNHAM

Waverley Borough Council is the Licensing Authority under the Riding Establishments Acts 1964 and 1970, and the purpose of this report is to determine an application for a full licence to operate a riding establishment at Old Park Stables, Old Park Lane, Farnham. The proposals in the report at
do not have any “Opportunities for All” implications and administration of this application will be met by current resource levels.
It is recommended that a full licence to operate a riding establishment be granted to Mr Carl Belson in respect of Old Park Stables, Old Park Lane, Farnham, Surrey.
CRIMINAL RECORDS BUREAU (CRB) – USE OF SHARED DISCLOSURES WITH ADJOINING COUNTY COUNCILS

The purpose of the report at
is to enable the Committee to advise the officers on the shared use of CRB information between this Council and Surrey Council. The report has no financial, environmental, “Opportunities for All”, Community Safety or Human Rights implications.
It is recommended that the Committee considers whether it would approve the officers accepting a Surrey County Council (or Hampshire or West Sussex CC) enhanced Criminal Records Bureau disclosure on an applicant for a Hackney Carriage or private hire driver or operator licence, provided that the disclosure is to be used only in the following circumstances:
1. in connection with an application for a licence renewal where there is an existing historical record (but not for a new licence application) and where the applicant has had no previous convictions (revealed by earlier checks) or, if there were previous convictions, these should have been a minimum of ten years previously;
2. the latest CRB disclosure effected by the other relevant local authority has been made within the previous three months (and one of the two original copies is seen by the officers);
3. the County Council (or other local authority) confirm that they have received the corresponding enhanced CRB disclosure copy.
ACTION TAKEN SINCE THE LAST MEETING
To note the following decisions taken by the Chief Executive since the last meeting of the Committee, following consultation with the Chairman and Vice-Chairman. The Register of Decisions will be laid on the table half an hour before the meeting.
Grant of Hackney Carriage/Private Hire Driver's Licence
Having considered the evidence in support of his application and being satisfied that the application met the 'of the fit and proper person' criteria of the Local Government (Miscellaneous Provisions) Act 1976, authorised that Mr R J T be granted a Hackney Carriage/Private Hire Driver's licence.
Application and CRB check (exempt) received.
Refusal to renew Private Hire Driver Licence on Medical Advice
Authorised the refusal to renew the Private Hire Driver's Licence of Mr R A C on the grounds that the advice of the Council's medical adviser indicates that this action be taken with immediate effect, because of his medical condition of diabetes.
There are no background papers (as defined by Section 100D(5) of the Local Government Act 1972) relating to this item.
EXCLUSION OF PRESS AND PUBLIC
To consider the following recommendation on the motion of the Chairman:-
That pursuant to Procedure Rule 20 and in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of the following item on the grounds that it is likely, in view of the nature of the business to be transacted or the nature of the proceedings, that if members of the public were present during the item, there would be disclosure to them of exempt information (as defined by Section 100I of the Act) of the description specified in Paragraph 4 of Part 1 of Schedule 12A to the Act, namely:-
Information relating to any particular applicant for, or recipient or former recipient of, any service provided by the authority.
