Summary and purpose:

Authority is sought to transfer a small area of land of around 140 square metres to Thames Water Utilities Limited, as shown hatched on the plan at Annexe 1, at nil consideration, with the company paying Waverley’s surveyor’s and legal fees.

The applicants will meet the Council’s legal costs.

Proposal

1. The area of land in question is shown hatched on the plan at Annexe 1. It has been included in Waverley’s registered title of the whole area shown outlined, but is, in fact, separated from it by the chain link security fence that encircles Thames Water’s sewage works.

2. It would appear that the land was incorrectly included within Waverley’s title in 1974 at the time of local government reorganisation. Owing to its obscured position, this was not picked up until Thames Water sought to register its land ownership in Farnham. As the land has clearly been part of the sewage works for many years, the company has requested that Waverley transfer it at nil consideration, with the company paying Waverley’s surveyor’s and legal fees.

Recommendation

It is recommended that the land shown hatched on the plan at Annexe 1 be transferred to Thames Water Utilities Limited at nil consideration with the company paying Waverley’s legal and surveyor’s fees, other terms and conditions being negotiated by the Property and Development Manager.
