Summary and Purpose

This report seeks authority for the granting of an easement of access across Council-owned common land to Chinthurst Cottage, Wonersh. There are no Environmental, Human Rights, Community Safety or “Opportunities For All” implications. The resource implications are referred to in the report.



Introduction and Background

1. In 1995, the then owners of Chinthurst Cottage, Wonersh, applied to the Council to construct a vehicular access to their property. At that time, it was agreed that they should be granted an annual licence.

2. The property has since changed hands and the present purchaser has been granted a licence on the basis that, subject to committee approval, he obtains an easement of vehicular access. As the access has not been used as of right for over twenty years, it is to be valued as a new easement and not according to the Scheme of Delegation regarding the regularisation of existing accesses.

3. Terms and conditions have been agreed and are set out in the (Exempt) Annexe to this report.

4. The Council will receive a capital sum for the easement.

5. As the access already exists, there are no environmental implications.

Human Rights/Community Safety/Opportunities for All Implications

6. There are none.

Recommendation

It is recommended that an easement of access be granted in respect of Chinthurst Cottage, Wonersh, on the terms and conditions set out in the (Exempt) Annexe to this report.
